GUIDELINES ON THE USE OF THE TRANS CERTIFICATION & INSPECTION SDN. BHD. CERTIFICATION MARK, DUTCH ACCREDITATION COUNCIL (RvA) ACCREDITATION MARK, AND GREEN GOLD LABEL (GGL) LOGO FOR GGL CERTIFIED CLIENT

  1. This guideline is meant to rationalize on the application of accreditation marks, and logo usage of TRANS Sdn Bhd certification mark, Dutch Accreditation Council (RvA) accreditation mark, and Green Gold Label (GGL) Logo for certified client within GGL scope of certification.
  2. This guideline is designed to provide information to client on usage of accreditation mark, certification mark, and logo, at the same time aim to prevent any misuse of the said marks.
  3. Prior application of any marks and logo stated within this guideline, approval via email at info@transcert.com.my shall be received from TRANS for the purpose of marks and logo usage. The approvals shall be recorded and retained by TRANS.

GUIDELINES ON THE USE OF THE TRANS CERTIFICATION & INSPECTION SDN. BHD. CERTIFICATION MARK

  1. These rules indicate the rules of TRANS certification marks shall be depicted and conditions relating to their use.
  2. The TRANS certification mark is entitled to companies who has been certified under TRANS within stated certified GGL scope.
  3. For multi-site organization, only sites whose activities are included in the scope of the certification may utilize the applicable certification mark. The right to use the certification mark does not extend to the parent company or to subsidiary(ies) of the certified client unless these entities are also included in the certification.
  4. The TRANS certification marks may be used on its own which appears on the TRANS’ GGL certificate issued to the client. The mark used shall clearly reflect the client/ client’s sites for which the client has been certified. The applicable certification mark when used on its own shall be as shown in Annex 1.
  5. The use of TRANS mark may be utilized in literature, stationery and advertising but it shouldn’t be used on products or packaging (both primary and secondary), and laboratory test, calibration or inspection reports or certificates, as such reports or certificates are deemed to be products in this context.
  6. The official of certification mark in Annex 1 may be obtained from TRANS through email at info@transcert.com.my after the approval of usage from TRANS Sdn Bhd.
  7. The use of TRANS’s name, corporate logo, trademarks or any intellectual property under any circumstances without prior written approval of the Operation Director is strictly forbidden.
  8. The requirements of the use of certification marks are as follows:
    1. All TRANS marks are sole property of TRANS Sdn Bhd and it shall be used according to the guidelines ONLY.
    2. The usage of marks shall be within the validity period of TRANS certificate.
    3. The certification marks shall only be reproduced in the predominant colour for the pre-printed material e.g. letterhead, stationery, newspaper, magazine articles.
    4. There is no minimum size requirement for the marks and associated text, however it must be legible and readily identifiable. The size of the certification mark may be reduced or enlarged uniformly as illustrated in Annex 1.
    5. The mark must be recognizable as TRANS Certification Mark and its size must be clearly smaller than the client’s company logo.
    6. The usage of the certification mark on the products, process or services may not be used to imply a relationship such as partnership with TRANS.
    7. The TRANS Certification Mark may be stand alone or to be associated or combined with any mark (e.g.: The client’s company logo, statement or graphics, RvA accreditation mark – to be further refer to next chapter). The use of the TRANS Certification Mark in particular must not give the impression that the client/certificate holder or its employee are members of the TRANS or that the TRANS Certification Mark is the client’s trademark/customer logo.
    8. The TRANS Certification Mark shall not be applied directly to the product or packaging, whether secondary or primary or in such a manner as to imply that any individual product, process or services is certified by this means.
    9. Any misused of the of the TRANS Certification Mark may result in the suspension or withdrawal of the certificate.
    10. The client/certificate holder shall discontinue immediately the use of the TRANS Certification Mark upon expiry or revocation of the Certificate, or for whatever reason(s) as decided by TRANS.
    11. TRANS reserves the rights to make amendments to this guideline and client/certificate holder will be informed via written notice of changes.

GUIDELINES ON THE USE OF THE TRANS CERTIFICATION & INSPECTION SDN. BHD. CERTIFICATION MARK WITH DUTCH ACCREDITATION COUNCIL (RvA) ACCREDITATION MARK

  1. With reference with Dutch Accreditation Council (RvA) – Regulation for the use of Accreditation marks and logo’s, the clients of accredited certification bodies for management systems, products, processes or services may use the accreditation mark under the conditions given in this chapter. It is the responsibility of TRANS to ensure the correct use of the accreditation marks by these clients. In case the, should TRANS cannot demonstrate to take appropriate measures for situations of misuse by its client or its former clients, this may have consequences for the accreditation of this body, as explained in policy rule RvA-BR002.
  2. When a Client of TRANS requires an activity, which is covered by the TRANS’s scope of accreditation, it is an implicit expectation of the customer that the activities will be conducted under accreditation, which will be confirmed by the use of the accreditation mark on the reports, certificates or declarations. So, for conformity assessment activities that are covered by the TRANS`s scope of accreditation, TRANS shall issue an accredited report, certificate or declaration.
  3. The obligation for above paragraph of this article shall lapse if explicitly agreed in a legal or documented arrangement between the TRANS and its customer. In these cases, the TRANS shall inform its customer that such reports, certificates or declarations are not accredited reports, certificates or declarations and are consequently not covered by EA-MLA, IAF-MLA or ILAC-MRA.
  4. The following rules apply to accredited certification of products:
    1. TRANS may authorize a certified client to apply the accreditation mark, in combination with the certification mark, to the product or to the packaging of the product if these products have been certified within the scope of accreditation.
    2. TRANS may authorise certified clients to use the accreditation mark in combination with the certification mark on letters and on other documents relating to products from these producers that have been certified under RvA accreditation, within GGL Certification scope.
    3. Excluded is the use of the accreditation mark on business cards of the certified client’s personnel.
  5. If the certified client uses the RvA accreditation mark it shall be used immediately next to, above or below the TRANS certification mark and shall not in any case be shown more prominently than the TRANS certification mark. In no way the suggestion shall be created that the certified organisation has been accredited by the RvA as shown in Annex 2.
  6. The combined may be uniformly enlarged or reduced as depicted in Annex 2. However, the accompanying text shall always remain legible.
  7. The RvA logo is listed in the Benelux Marks Register under number 1009112. The colour scheme of the logo is specified below.
  8. The text used within the accreditation mark under the logo is printed in blue (PMS 296) or black. The whole accreditation mark may also be shown in black or in one colour of the body’s house style. The ratio of the height of the logo to the height of the two lines of text shall be approximately 3:2. – Refer Annex 2.

 

  1. The maximum height with which the whole accreditation mark may be used on documents is 45 mm. Used directly beside, above or below the logo of the accredited body (TRANS) the accreditation mark may be shown larger, but never larger or more prominent than the logo of the accredited organization. When deciding on the size of accreditation mark to use, the body must take account of the legibility and recognizability of the mark, the accredited activity it covers and the integrated registration number. – Refer Annex 2.

GUIDELINES ON THE USE OF THE GREEN GOLD LABEL (GGL) LOGO

  1. With reference to GGLS1 – Chain of Custody Criteria, Appendix A. Logo Use Requirement, regulation for the use of GGL Logo are as below stated. The logo for GGL is below picture.

  1. On the product labelling is not permitted for GGL Logo application.
  2. GGL can only be claimed on products covered by a Transaction Certificate as described in GGLS4 (Transaction and product Certificate).
  3. The registered and copyrighted GGL logo is made available to participants with a valid GGL certificate.
  4. The GGL logo may be used off product, including on stationery, promotional materials, business cards and brochures.
  5. The GGL logo artwork may be used only in horizontal alignment.
  6. The minimum size for the GGL logo is 12mm in height.
  7. Claims regarding electricity produced from GGL certified biomass are laid down in GGLS6 (Power Company Criteria).
  8. Any applied percentages shall reflect the actual percentages of certified material included in a product or batch, in case recycled material is included in GGL certified materials information shall be provided on the percentages and quantities of the included recycled materials.
  9. The GGL logo shall not be used in relation to any GGL controlled claims and statements.
  10. Approval shall be received from the Trans for applying any GGL logo’s and claims for promotional purposes.

MISUSE OF THE TRANS CERTIFICATION MARK, RvA ACCREDITATION MARK AND GGL LOGO.

  1. It is strictly forbidden for any recreating or reproducing of the TRANS’ GGL certification mark, RvA accreditation mark and GGL Logo without prior written approval by TRANS.
  2. An act of misuse the certification mark shall be considered if there is any act such as addition and/or omission by certified client with or without intention that has breach the term and guidelines provided.
  3. Where TRANS received a complaint, TRANS shall have the right to make an investigation related to the relevant client without prior notice to the certified client.
  4. The termination a of certified client and also the agreement with the certified client shall be taken by TRANS if there’s evidence of misuse of the TRANS’ GGL certification mark shown.
  5. TRANS shall have the right to claim from the certified client for any loss and cost incurred that TRANS has to suffer as a result of the misuse including legal proceedings and public notifications costs.
  6. Where the remedy provided by arbitration is insufficient to cover the loss and cost suffered by TRANS due to misuse, TRANS shall have the right to make a claim through court jurisdiction.
